Website Terms of Use

1. Acceptance
These Website Terms of Use ("Terms") govern access to and use of the website at netta.network and its subdomains (the "Site"). By accessing the Site you agree to these Terms. If you do not agree, do not use the Site.
2. Who we are
The Site is published by FiatRails Foundation Ltd, an exempted foundation company incorporated in the Cayman Islands (Registration No. 431901; LEI 894500RG1F2BKNE8P514), whose registered office is at Landmark Square, Camana Bay, Grand Cayman, Cayman Islands (the "Foundation", "we", "us"). NETTA — The Settlement Computer — is a product of FiatRails Foundation Ltd.
3. Nature of the content
The Site is an information resource for institutions and their advisers. Its content is provided for general information only and does not constitute an offer, an invitation or a solicitation of any kind, nor legal, financial, regulatory, tax or investment advice. Nothing on the Site should be relied upon in making any decision.
Figures, metrics and performance characteristics described on the Site derive from test-network operation on generated test flow. They are not production performance and do not represent results any institution will achieve.
NETTA is a technology service provider. It computes settlement instructions for licensed financial institutions. It does not hold or transfer funds, does not take deposits, does not execute foreign exchange and does not act as counterparty, custodian, payment service provider or market maker in any transaction. All licensable activity remains with participating institutions in their own jurisdictions.
4. No services are provided through the Site
The Site does not provide, and use of the Site does not create any right to, any product or service. Participation in any pilot, evaluation or production arrangement is governed solely by written agreements entered into with the relevant group operating entity, and by any non-disclosure agreement that precedes them. Submitting a briefing request through the Site creates no obligation on either party.
5. Intellectual property
The content of the Site, including text, graphics, diagrams, logos and the NETTA and FiatRails names and marks, is owned by FiatRails Foundation Ltd or licensed to it, and is protected by copyright, trade mark and other intellectual property laws. The Qedis privacy runtime referred to on the Site is owned by Digitalyze Labs Ltd and licensed to the FiatRails group. The technology described on the Site is the subject of pending patent applications.
No licence to any intellectual property is granted by your use of the Site. You may view and print pages for your own internal reference. You may not otherwise reproduce, modify, distribute or use any content or mark without our prior written consent.
6. Acceptable use
You agree not to use the Site in any way that is unlawful, that interferes with its operation or security, that attempts to gain unauthorised access to any system or data, or that scrapes, harvests or republishes content or personal data from the Site. You agree not to submit false or misleading information through any form on the Site.
7. Third-party links and services
The Site may link to third-party websites and may use third-party services to deliver forms and newsletter subscriptions. We do not control and are not responsible for third-party sites or services, and a link does not imply endorsement. Your use of any third-party service is subject to that provider's own terms.
8. Disclaimer and limitation of liability
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING AS TO ACCURACY, COMPLETENESS, TIMELINESS, AVAILABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
To the fullest extent permitted by law, the Foundation, its directors, officers, affiliates and licensors shall not be liable for any direct, indirect, incidental, consequential, special or punitive loss or damage arising out of or in connection with access to, use of, or reliance on the Site or its content. Nothing in these Terms excludes liability that cannot be excluded by law.
9. Changes
We may amend these Terms at any time by posting a revised version on this page with a new effective date. Your continued use of the Site after a revision is posted constitutes acceptance of the revised Terms.
10. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or the Site, are governed by the laws of the Cayman Islands. The courts of the Cayman Islands have exclusive jurisdiction over any such dispute or claim.
